The term “bail” refers to the procedure used to secure the release of a person who has been charged with a crime by guaranteeing his future appearance in court for a trial and requiring him to stay within the court’s territorial jurisdiction.

Bail is defined as “the security required by a court for the release of a prisoner who must appear at a future time.” By bringing the accused before the court,via arrestit is  meant to serve justice. There is no need to breach his liberty, if the same result can be obtained without making any arrest and hence there is an concept of bail.
