Anything said/done/written by one of the conspirators is relevant against each of the persons believed to be conspiring for two purposes:
- for the purpose of proving the existence of conspiracy, and
- (ii) for the purpose of showing that any such person was a party to it.
Only when something is spoken, done, or written in regard to the conspiracy’s common aim is it admissible against the speaker and the other defendants in a conspiracy charges. “In furtherance of the common object” is the expression used in accordance with the comparable English law statute. The phrase “in reference to their common intention” is undoubtedly more expansive than the phrase used in English law. While the act’s object is to achieve the goal, the thing being pursued, and the mental decision that comes before it, the act’s intention is the mental decision that comes before it. While the term “object” refers to the goal for which the resolution was formed, “intention” suggests the mental resolution.
