There are several types of torts, including:

  1. Intentional Torts: These are torts where the defendant purposely acts in a way that results in harm to the plaintiff. Examples include assault, battery, defamation, false imprisonment, and intentional infliction of emotional distress.
  • Negligence Torts: Negligence is the most common type of tort. It occurs when the defendant fails to exercise reasonable care, resulting in harm to the plaintiff. To establish negligence, the plaintiff must prove the existence of a duty of care, breach of that duty, causation, and damages. Car accidents, slip and fall cases, and medical malpractice are common examples of negligence torts.
  • Strict Liability Torts: These are torts where liability is imposed on the defendant without the need to prove fault or negligence. Instead, it is based on the fact that the defendant engaged in a particular activity or owned a dangerous object that caused harm. Product liability cases, where a defective product injures a user, are an example of strict liability torts.
