Contents of “Charge” (Section 211)

Through its 7 segments, Section 211 specifies that the “Charge” must identify the offence the accused has been charged of. Charges should be individually framed by the trial court if there are multiple accused. The charge must be written in the court’s official language. Offence should mention the name if it has one.
Not in all cases but in some the manner of committing the offence can be described , in case the offence does not have a specific name or word in I.P.C here the detailed description of the offence will be given. In case of a previous conviction the charge can be framed after the judgment is delivered but before the sentence hearing. As per section 212 charge can even disclose the name of complainant .
