In Badri Prasad v. State of Madhya Pradesh, AIR 1970 SC 706, the Supreme Court ruled that the definition of goods in Section 2(7) of the Act makes it clear that items fixed to the land may be the subject of a contract for the sale of goods, despite the definition of movable and immovable property in the General Clauses Act, so long as it is made clear in the contract’s terms that they are to be severed from the land. Trees, doors, and windows may thus be cut out of the ground and sold as products.
