Wrongful Confinement

Confinement, also known as wrongful confinement or illegal confinement, is a more serious offense than wrongful restraint. It involves intentionally restraining a person’s movement by confining them to a particular space against their will and without lawful authority.

Elements of Confinement:

  • Intentional Act: There must be an intentional act by the accused to confine the person against their will.
  • Unlawful Confinement: The confinement must be unlawful, meaning there is no legal justification or authority for it.
  • No Consent: The person being confined did not give their consent to the confinement.
