Under the Indian Evidence Act, a handwriting expert is a person who possesses specialized knowledge and skills in examining and comparing handwriting samples to determine their authenticity, genuineness, or authorship. Handwriting experts play a crucial role in legal proceedings by offering their opinions on the similarity or dissimilarity of handwriting samples and providing expert testimony in court.

Section 45 of the Indian Evidence Act, of 1872, deals with the opinions of experts and states:

“Opinions of experts.—When the Court has to form an opinion upon a point of foreign law, or of science, or art, or as to the identity of handwriting or finger impressions, the opinions upon that point of persons specially skilled in such foreign law, science or art, or in questions as to the identity of handwriting or finger impressions, are relevant facts.”

This section allows the opinions of experts to be admitted as evidence in court. Handwriting experts fall under the category of experts mentioned in this section, specifically concerning the identity of handwriting.
