STALKING UNDER IPC

Section 354-D of IPC penalizes the offence of stalking . It states that any man would be held guilty of this offence either

Follows a woman and contact/ attempts to contact her repeatedly to foster interaction / personal communication even though the woman has clearly indicated her disinterest.
Monitors a woman and  either by using internet, email or other form of electronic communication.

Proviso (Exceptions)

He pursued such a woman on directions of state for the purpose of detecting or preventing crime
He pursued her under the given law of the land or to fullfills with the requirements of the law imposed on such person.
Based on the facts and the circumstances it was a reasonable and justifiable act.

Punishment of Stalking:

For the first time conviction: Imprisonment of either description term extending upto three years and fine. For the Subsequent Conviction: Imprisonment of either description for a term extending upto 7 years and fine.
