Every conspirator is an agent of his group in carrying out the conspiracy’s objective, according to the notion of agency, which is the fundamental premise emphasised under Section 10 of the law. The commonality of interest and existing community of purpose between the parties serve as the foundation for the rule. Similar to how one partner in a partnership is seen to be the agent of the other, one conspirator is considered to be the agent of the other, and anything they say, do, or write is assumed to have been done by the other conspirator.
The justification for Section 10 is best exemplified by J. Sinha’s statements in the case of Badri Rai v. State of Bihar, “A conspiracy is planned in secret and carried out at night.” Therefore, unless there is a common Bond connecting all of them together, it is obviously impossible for the prosecution to connect each individual conduct or statement of one accused with the acts or words of the others.
