OBJECT AND SCOPE OF COPYRIGHT

The object of copyright is mainly two fold:

First and foremost, to prevent unauthorised duplication or use of the author’s work by third parties. The goal is to award authors, composers, and artists with the exclusive right to reproduce their original works for a brief time in order to motivate them to generate new ones. By offering various forms of protection for creative expression, the copyright law promotes creativity. By granting advantages to creators, copyright rules promote the creation of original works.

Second, the copyright law permits some unrestricted uses of the protected content. Section 52 of the Copyright Act of 1957 contains a list of these permissible unrestricted uses. To achieve an equilibrium between the objectives of the copyright owner and those of society at large, measures relating to unrestricted uses are included in the Act. Hence, in the benefit of society, a small portion of the copyright owner’s private rights have been restricted.

Not stealing is the moral justification for copyright protection under copyright law. The law forbids one from using another’s labour, ability, or capital to generate anything for oneself.
