Meaning of Conspiracy

April 29, 2023

According to Section 120A of the IPC, “No agreement, other than an agreement to commit an offence, shall amount to criminal conspiracy unless some other act, other than an agreement, is done by one or more parties to such agreement in pursuance thereof.”

There are three key components to it: (a) two or more people, (b) an agreement, and (c) an illegal object. A conspiracy is when two or more people decide to work together to do an illegal conduct as a means or an end. A conspiracy is when two or more people agree to commit an illegal act or to carry out a legal action in an illegal manner, rather than just having the intention to do so. Such a plan is not criminally punishable as long as it is based solely on purpose. The plot itself becomes an act when the two decide to put it into action.
