Intent Behind Framing Charge

June 15, 2023

According to Mohan Singh v. State of Bihar, (2011) 9 SCC 272, “the intent behind framing a charge is to give indication to the accused of concise and specific notice of the type of allegations that the Accused is called upon to meet in the course of a trial.”
The Code stipulates that in cases of major offences, information gathered must be converted into a document and given to the accused for better accuracy and legibility. The accused is next given a reading and explanation of the Charge. It is not regulated as mandatory or discretionary for the accused to sign the charge.
