IDEA CANNOT BE SUBJECT OF COPYRIGHT

March 18, 2023

It cannot be claimed by someone who only conveys the idea for a narrative, image, artwork, or play to another who dresses the concept in a formal form. As there is no copyright for ideas, a person who develops a concept for a book, a painting, or a play does not suddenly become an author. The person who expresses the concept through written, visual, or artistic means is the author.

Farwell J. noted at p. 110 in Donogue v. Allied Newspapers Ltd. (1937) 3 All ER 503 that there isn’t such a thing as copyright if the concept, no matter how original, is nothing more than an assumption or is not expressed in any form of words or expression, such as a picture. There is no copyright until it is reduced to writing or another tangible form, and then only in the specific language form in which the information or concept is communicated to those who are intended to read it or look at it.
