THE COPYRIGHT (AMENDMENT) ACT, 2012

The World Intellectual Property Organization (WIPO) Copyright Treaty or WCT, 1996, and the WIPO Performances and Phonograms Treaty (WPPT), 1996, were brought into compliance with the Copyright Act, 1957, to the extent deemed necessary and desirable, through the creation of the Copyright (Amendment) Act, 2012. In order to address issues with the protection of copyrights and related rights brought on by digitalization, especially the web, WCT and WPPT were both negotiated in 1996

I. New Sections Introduced

(1) The amendment introduced a new definition of the following expressions:

(i) Commercial Rental [Section 2(fa)]

(ii) Rights Management Information [Section 2(xa)]

India brought the Copyright Act, 1957 into line with Articles 12 of the WIPO Copyright Treaty and 19 of the WIPO Performances and Phonograms Treaty by incorporating Rights Management information in Section 2(xa). With the preservation of identifier in the work and governance over it through a digital rights management (DRM) system, the concept was extended with the intention of assisting the material producing industry in efficiently combating digital piracy.

 (iii) Visual Recording [Section (xxa)]

(iv) Sections 65A and 65B were introduced to penalise people who engaged in plagiarism or piracy by stealing someone else’s copyrighted content using technology and then profiting from that content.
