The investigating authority must submit the chargesheet within the allotted time, according to Section 167(2) of the Criminal Procedure Code. Depending on the type of offence, different deadlines apply for submitting the chargesheet. The required period is sixty days from the date of the accused’s arrest for acts carrying a maximum sentence of seven years in prison or less.
The required time is ninety days from the date of the accused’s arrest for offences carrying a potential punishment of more than seven years in prison. The accused is freed on default bail if the investigating body does not submit the chargesheet within the allotted period.
