Re-examination of a Witness

August 7, 2023

Re-examination is the third and final stage of questioning a witness during a legal proceeding, and it is governed by the Indian Evidence Act, 1872. Re-examination occurs after the cross-examination of the witness, during which the party who originally called the witness has the opportunity to ask additional questions to clarify or explain any matters that arose during the cross-examination.
Re-examination is an important stage as it allows the party calling the witness to address any damage to the witness’s credibility or testimony caused during cross-examination. It helps to maintain the balance in the presentation of evidence and ensures that the court gets a complete and accurate account of the witness’s testimony.
