Primary evidence refers to the strongest, most unique, or first-presented evidence. Whereas secondary evidence is an alternate form of proof that can be used in place of primary evidence. It is the substituted evidence that suggests the existence of the evidences’s original source. A certified copy of the original document, for instance, is secondary evidence. Primary evidence is the type of proof that provides the facts with the greatest degree of certainty. Secondary documentary evidence is the evidence of copies, etc. of documents that are admissible in specific situations (Sections 63 and 65) as opposed to primary documentary evidence, which is the evidence of the original documents themselves produced for the Court’s inspection (Section 62).
