Jaipur Bomb Blast : The trial verdict of weak evidences
The Rajasthan High Court quashed the conviction and death sentence given to four men by the trial court on March 29 in the matter of the series of explosions that occurred in the City of Jaipur in May 2008, killing 71 people and injuring 200 more. The places in Jaipur were the blast occurred were Maanak chowk, Chandpole Gate, Badi Chopad , Choti Chopad, Tripoliya Gate and Sanganeri gate. The court also accepted one of the accused’s statements that he was a juvenile and acquits the fifth accused.
Mohammed Saif, Mohammed Sarwar Azmi, Saifur Rehman, and Mohammed Salman received the death penalty in December 2019 after being found guilty of detonating the bombs and carrying out the explosions by a special court in Jaipur. Shahbaz Ahmed, the fifth accused, who was convicted of sending an email claiming credit for the explosions, was found not guilty due to a lack of evidence.
The weak state of Evidences, according to the Rajasthan High Court:
There is no proof to support the claim that the accused travelled between Delhi and Jaipur and bought the bicycles, according to the ruling, which was issued after a 48-day hearing on the appeals filed by the four people and the death reference submitted by the State government. The court found that several important witnesses were not questioned and that the identification of the accused by critical witnesses was not accurate.
The court upheld Mr. Ahmed’s acquittal and stated that the e-mail that he is accused of sending on behalf of the Indian Mujahideen accepting responsibility for the explosions was inadmissible in law. Also, the Juvenile Justice Board had approved Mr. Salman’s plea, thus the court accepted the argument that he was a minor at the time of the offence.
Rajesh Maharshi, an additional attorney general, stated that the State government would move the Supreme Court for special leave to appeal the acquittal.
