The second half of the section makes an exemption in favour of acts carried out at the instruction of a public servant as the first part of the section deals directly with the act performed by the public servant. The one who is acting does not have to be a public servant. This phrase must be read in conjunction with Rationale 2.
The clarification makes it clear that the exception only applies in cases where the person knows or has good grounds to suspect that the act is being carried out under such instruction. He is not prevented from using his right to private defence if he is not aware or has no cause to suspect that the action was ordered by a public official.
