Shelter of Right to Private Defence

May 31, 2023

Raj Pal v State of Haryana, (2006) 9 SCC 678

There is no automatic right to a private defence that extends to causing death just because there was a fight and some of the accused received injuries.

It must be proven that the accused person had such serious concerns about the security of their life and property that taking revenge to the level that they did was absolutely required. The right to individual defence has been correctly abandoned. The individual cannot exercise beyond the legal and actual requirement and act must be condoned.
