Section 3 of Transfer of Property Act provides for a concept called Notice which in simple sense called Knowledge. The Notice can be of two types:

  1. Actual Notice;
  2. Constructive Notice.

Actual notice means a direct notice or express knowledge where a person has been information either in written or oral form, it is actual notice but the information must be definite knowledge not hearsay.

There can be a situation where the Notice is not direct or the knowledge has not been given to the person but if with reasonable efforts the person can find out the information or the fact even though he doesn’t make an attempt to find it, it would be deemed that he has knowledge or Notice called as Constructive Notice. E.g. if the documents of ownership has been handed over to the prospective buyer then there would be constructive notice of the content of the documents and he cannot claim the defence that no direct knowledge was given to him.
