When the police officer has adequate proof and justifiable grounds, he must present the accused to the magistrate within 24 hours of investigation so latter may allow the police custody or if not then judicial custody.
Though the regular bail can be tried in this whole period. If the offence is bailable, the accused will provide security and released on bail with the condition that he only appear before the magistrate when necessary and that he regularly appear in court on and as when asked. In case when regular bail is not granted the accused is also entitled to default bail.
