Actus reus and mens rea are two fundamental concepts in criminal law that help determine whether a person is guilty of committing a crime. These terms originate from the Latin language and represent the “guilty act” and the “guilty mind,” respectively.
Actus reus: Actus reus refers to the physical or external element of a crime. It encompasses the actions, conduct, or behavior that constitutes the forbidden act basically the consequences of an act inclusive of omission. To establish actus reus, the prosecution must prove that the accused individual voluntarily performed the prohibited act or failed to act when they had a legal duty to do so.
