A police officer encountered resistance and obstruction when he tried to enter a home without a search warrant to look for allegedly stolen belongings.
Although the officer was not strictly justified in searching the house without a warrant, it was decided that the person hindering and opposing could not use the officer’s illegality as a defence for his impediment because it had not been established that the officer was acting anything other than in an act of good faith and without maliciousness.
