There may be more evidence outside the testimonies of the witnesses, such as documentation. Documentary evidence is defined in Section 3 as “any papers, including electronic records, produced for the inspection of the Court.” Only when a document is presented to the court in favor of a party’s claim and is only intended for the court’s review is it considered evidence. So, a documented evidence is a physical item that can support an accurate claim. Hence, a writing that the court got from the accused for comparison is not evidence because it is not a document that was produced for the court’s examination, according to the ruling in Ram Swarup v. State, AIR 1958 All 119.
